1. Acceptance of Terms

By downloading, installing, or using Rojo (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Ionic Ventures LLC, an Alabama limited liability company, doing business as Rojo (“we,” “us,” or “our”).

2. Description of Service

Rojo is a mobile application designed to help parents and caregivers track infant and toddler activities including feedings, diaper changes, sleep, pumping sessions, growth, and medicine. The App provides logging tools and statistical dashboards to support caregiving decisions.

Rojo is not a medical device and does not provide medical advice. Information logged in the App is for personal tracking purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years of age to use this App. By using Rojo, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 To access certain features of the App, you may be required to create an account using a valid email address, Google account, or Apple ID.

4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.3 You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4.4 You must notify us immediately of any unauthorized use of your account at support@rojobaby.app.

4.5 We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.

5. User Data and Content

5.1 Your Data: All tracking data you enter into the App (feeding logs, diaper logs, sleep logs, pumping logs, growth logs, medicine logs, baby profiles) remains yours. You retain ownership of your personal data.

5.2 Baby Profiles: You may create profiles for one or more children. You represent that you are the parent or legal guardian of any child whose information you enter into the App, or that you have been authorized by a parent or guardian to do so.

5.3 Data Accuracy: You are solely responsible for the accuracy of data you enter. Rojo is not responsible for decisions made based on inaccurate user-entered data.

5.4 Data Backup: While we take reasonable measures to protect your data, we recommend maintaining your own records for critical health information.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to collect or store personal data about others without their consent
• Impersonate any person or entity
• Upload or transmit viruses or malicious code
• Use automated scripts or bots to interact with the App

7. Not Medical Advice

IMPORTANT: Rojo is a tracking tool only. Nothing in the App constitutes medical advice. Always consult a qualified healthcare professional, pediatrician, or lactation consultant for medical questions regarding your child's health, feeding, growth, or development. Do not delay seeking medical attention based on information in this App.

8. Intellectual Property

8.1 The App, including its design, code, graphics, logos, and content, is owned by Ionic Ventures LLC and protected by applicable intellectual property laws.

8.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8.3 You may not copy, modify, distribute, sell, or sublicense any part of the App without our prior written consent.

9. Third-Party Services

The App may integrate with third-party services including but not limited to:

• Supabase (database and authentication)
• Google Sign-In
• Apple Sign-In

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimers and Limitation of Liability

10.1 AS IS: The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee of Availability: We do not guarantee that the App will be available at all times or free from errors, bugs, or interruptions.

10.3 Limitation of Liability: To the maximum extent permitted by applicable law, Ionic Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages.

10.4 Maximum Liability: Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ionic Ventures LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the App or violation of these Terms.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last Updated” date at the top of this page and, where appropriate, through in-app notification. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Termination

14.1 You may stop using the App and delete your account at any time.

14.2 We reserve the right to suspend or terminate your access to the App at our discretion, with or without notice, for any violation of these Terms.

14.3 Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

15. Governing Law and Dispute Resolution

15.1 These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions.

15.2 Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

15.3 Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative action.

16. App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Ionic Ventures LLC only, and not with Apple. Apple has no obligation to provide any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

17. Children's Privacy

Rojo is intended for use by adults (18+) to track infant and child data. We do not knowingly collect personal information directly from children under the age of 13. Data entered about children (such as baby profiles) is entered by adult users and is subject to our Privacy Policy.
